Cavac Terms of Use

1. Introduction

These Terms of Use govern access to and use of Cavac, a mobile/web product operated by Victor Aguiar Souza Springer.

Cavac is an app for studying, practicing, and accompanying cavaquinho and Brazilian banjo, focused on samba and pagode. The product provides accompaniment-focused chord charts and features such as a chart library, chart reading view, playback, study tools, search, private favorites, read-only sharing, in-app chart publishing, chord dictionary, tuner, and metronome.

The product's main format does not include lyrics, melody, or sheet music. By creating an account, accessing, or using Cavac, you agree to these Terms and to the product's Privacy Policy.

2. Eligibility and account

You must have the legal capacity to accept these Terms and use the product in compliance with applicable law. You must be at least 13 years old to use Cavac. If the law applicable in your country requires a higher minimum age, or parental or guardian authorization, that rule will prevail.

Victor Aguiar Souza Springer offers access through email/password authentication and Google sign-in. To use certain features, you may need to keep an active account and a profile with basic information, including first name and last name when required by the product flow.

You are responsible for:

  • providing accurate and updated information
  • keeping your credentials confidential
  • all use of your account

3. Permitted use

Victor Aguiar Souza Springer grants you a limited, revocable, non-exclusive, non-transferable license to use Cavac through the features made available in the product and subject to these Terms.

You must not:

  • use the product unlawfully or in violation of third-party rights
  • upload, publish, or share content without responsibility or permission to do so
  • try to bypass technical, access, or visibility restrictions
  • use the product to distribute lyrics, melody, full sheet music, or other material outside the Cavac format
  • copy, exploit, or redistribute the product or editorial content in an unauthorized way

4. User content

You remain responsible for the content you create, save, duplicate, organize, share, or publish in the product, including charts, metadata, and authorship information associated with that content.

By submitting or publishing content in Cavac, you represent that:

  • you are responsible for the content submitted to the product
  • use of that content in the app does not violate the law or third-party rights

To operate the service, Victor Aguiar Souza Springer receives a limited, non-exclusive license restricted to what is necessary to store, technically reproduce, process, format and display, make that content available inside the product, maintain technical backups, and review or moderate that content according to the visibility and sharing settings you apply and the service's operational, legal, and security needs.

5. Authorship, control, and visibility

Cavac may include charts created by users.

When the product shows visible authorship for a chart, that visible authorship is the credit displayed in the app to identify who appears as the author of that chart within the product environment.

The visible authorship shown by the product may correspond to the display name or visible profile name associated with the source account for that chart. Email addresses and login credentials are not intended to appear as public authorship credits.

The account that created or maintains the original chart in the app remains the reference point for control of that chart inside the product, including publishing and sharing settings, subject to the product's available behavior.

Publishing a chart means making it visible to authenticated users inside the app. Publishing does not mean a public website, an open public link, or indexing outside the app.

If a chart is not published, it does not enter that general in-app visibility. This does not prevent specific access resulting from valid sharing when that feature is used.

Publishing a chart does not transfer authorship, does not transfer control of the account-linked original chart, and does not turn the product into a collaborative editing environment.

6. Sharing and copies

In Cavac, sharing is read-only. Sharing a chart does not grant permission to edit the original chart.

A recipient may only duplicate a shared chart as a separate private copy, without changing the original. That separate private copy exists as a distinct item inside the product.

Favorites are private per user. Victor Aguiar Souza Springer treats favorites as an individual organizational feature of each account.

7. Editorial content

Victor Aguiar Souza Springer may provide study progressions and other editorial study materials within Cavac.

That content may be updated, reorganized, unpublished, or removed at any time for editorial, operational, or legal reasons.

8. Content complaints and removal

Complaints about infringement, authorship disputes, misuse, or other challenged content may be sent to contact@cavac.app.

To support a minimum review, a complaint should, whenever possible, include:

  • identification and contact details of the complainant
  • identification of the challenged chart or content
  • an objective description of the complaint
  • an explanation of the complainant's connection to the claimed right or interest
  • supporting materials or available supporting information

Upon receiving a reasonable complaint, Victor Aguiar Souza Springer may request additional information and may review, restrict, unpublish, or remove the content from the product while the matter is assessed.

This section does not require Victor Aguiar Souza Springer to maintain a complex formal adjudication procedure, but it allows proportionate action to protect the product, users, and third parties.

9. Intellectual property

The software, the interface, the Cavac brand, editorial content, and other service elements belong to Victor Aguiar Souza Springer or their respective rights holders, as applicable.

These Terms do not transfer any ownership rights in the product to you.

10. Suspension and termination

Victor Aguiar Souza Springer may restrict features, suspend access, unpublish or remove content, or terminate accounts when necessary to:

  • comply with the law or a valid order
  • protect the security, integrity, or operation of the service
  • investigate misuse, violations of these Terms, or reasonable complaints
  • reduce relevant technical, operational, or legal risk

You may stop using the product at any time. When the feature is available for your product version, an account deletion request may be started inside the app at Settings > Account > Delete account. Deletion is not the same as signing out and may retain strictly necessary data when required for legal, security, or backup reasons.

11. Basic limitations

Victor Aguiar Souza Springer operates Cavac as a study, practice, and musical accompaniment product. The service may be subject to maintenance, downtime, feature changes, and catalog or content adjustments.

Victor Aguiar Souza Springer does not guarantee that the service will always be uninterrupted, error-free, or fit for your specific purpose. It also does not guarantee that every chart will be complete, accurate, current, or suitable for your musical context.

Nothing in these Terms limits rights that cannot be excluded under applicable law.

12. Changes

Victor Aguiar Souza Springer may update these Terms to reflect changes in the product, service operation, or legal requirements. The current version will be made available together with its effective update date.

13. Language

These Terms may be made available in more than one language. In the event of a material divergence between versions, the Brazilian Portuguese version will prevail unless applicable law requires a different interpretation.

If applicable, these Terms are governed by the laws of Germany, without prejudice to mandatory consumer rights under applicable law, including mandatory consumer rights in Brazil where that protection applies. The competent venue will be the one legally applicable, taking into account Victor Aguiar Souza Springer's domicile in Berlin, Germany, and mandatory consumer protection rules.
